The Federal High Court in Calabar, on Monday awarded N75million cost against the Nigerian navy for illegal use of military weapon, shooting and torturing of one Asuquo Etim ,a bricklayer by one of its personnel attached to quick intervention squad during operation "papa five".
Delivering the judgement, justice
Inyangekwo directed that the Nigerian navy which was a respondent in the
case to pay seventy five million naira to the plaintiff as compensation
and general damages.
he explained that the navy authority
cannot dissociate itself from its personnel who misused the firearms
given to him by the organization, insisting that wrong use of military
weapon against a lawful citizens was unconstitutional and punishable
under the law.
Both the defence and prosecuting
counsels hailed the judgement of the court while the plaintiff thanked
the judiciary for being the last hope of the common man .
AIT's Rasheed Olanrewaju reports that
Asuquo Etim through his lawyer had in his suit marked fhc/ca/m35/2013,
prayed the court to award him N75 million as damages for shooting,
torturing and making him incapacitated by the officer of the Nigerian
navy that made him to be bedridden for seven months with handcuff,
without committing any offence on eleventh of October 2012.
